A NIGHTMARE FOR POLICE OFFICERS

The one enduring feature of the Zodiac Killer is his ability to play with words, often using contemporary stories in the newspapers to surreptitiously weave into his communications. But was November 1966 one such instance, when the landmark story of "the confession" heavily featured in the newspapers throughout the year to the chagrin of law enforcement, who would become three years later, the target of mockery and ridicule at the hand of the Zodiac Killer. 

On June 13th 1966 Miranda v. Arizona, 384 U.S. 436, was a decision of the U.S. Supreme Court in which the Court ruled that law enforcement in the United States must warn a person of their constitutional rights before interrogating them, or else the person's statements or confession cannot be used as evidence at their trial. Specifically, the Court held that under the Fifth Amendment to the U.S. Constitution, the government cannot use a person's statements made in response to an interrogation while in police custody as evidence at the person's criminal trial unless they can show that the person was informed of the right to consult with a lawyer before and during questioning, and of the right against self-incrimination before police questioning, and that the defendant not only understood these rights but also voluntarily waived them before answering questions.

Ernesto Arturo Miranda (March 9, 1941 – January 31, 1976) was an American laborer whose criminal conviction was set aside in the landmark U.S. Supreme Court case Miranda v. Arizona, which ruled that criminal suspects must be informed of their right against self-incrimination and their right to consult with an attorney before being questioned by police. This warning is known as a Miranda warning. Ernesto Miranda had been convicted of kidnapping, rape, and armed robbery charges based on his confession under police interrogation. Wikipedia.

This was met with dismay by many police departments the length and breadth of the country, who feared the balance of power shifting toward the criminal. with the day-to-day operations of law enforcement being shackled by the ruling of the Supreme Court. A confession was now inadmissable without a prior Miranda warning.from interrogating officers. This may have amused the Zodiac Killer (or author of the Confession letter) when they twice addressed Chief Lambert Kinkead of the Riverside Police Department and headed two letters on November 29th 1966 with "THE CONFESSION", reminding them of a prior "WARNING" they issued to police, typing "Yes I did make that call to you also. It was just a warning". This form of mockery wouldn't have been lost on the Zodiac Killer, had he been present in Riverside during this period. A "just warning" by telephone, followed by a typed confession of murder to police.

THE CONFESSION BY ________________-

this seems similar to how Zodiac taunted his unknown identity in the April 20th 1970 letter (MY NAME IS________________) and I think in the first couple of letters from Zodiac he seemed to be teasing his identity, saying police would have it when they cracked the Z408 only then to say later that he would not give police his name. I do feel that toying with his unknown identity was a part of Zodiac's taunting behaviour

this reminds me how Zodiac would hint at possible future victims in his July 31st 1969 letter if the cipher was not printed, his little list letter when he said he would torture his slaves, and his Nov 9th bus bomb letter when he said he would change the way he collected slaves. Just there sees to be always a thought of other victims in both authors minds

reminds me of the line in the Nov 9th letter where Zodiac says he has been "too clever" for the police, both authors maybe thinking in terms of relative intelligence of the people they encounter to themselves

I FIRST PULLED THE MIDDLE

this really reminds me of how Zodiac would go into descriptive detail about his crimes in his Aug 4 debut of Zodiac letter, the writing about the attack on Mageu & Ferrin but also the explanation of how he could shoot in the dark at Lake Herman Road, and the later description of his bombs in his bus bomb letters, he does give a kind of running commentary on his activities with what I feel is a peculiar amount of detail (whether true or not is a differen matter).

I do have to point out here that while it is often stated the confession letter writer could have got the details of how the car was disabled from the newspaper, they were not all accurate in recording the distributor wire was simply disconnected, some say the wiring was ripped or yanked out, so if the confession letter writer was a hoaxer he seems to have avoided using the incorrect descriptions of how the car was disabled. The attack on CJB seems savage to me, if I wanted to hoax that I disabled her car I might go with the stronger description of ripping the wiring out rather than just disconnecting it.

reminds me a bit of the Z408 plain text how killing was better than getting your rocks off with a girl, just interesting both letter writers manage to get a sexual reference in to 2 early correspondances that are about killing people. Zodiac never made any reference to sex ever again and I think maybe he did this intentionally as he felt he had gave too much about his psychpathology away and did not want to read speculation about being a sex-killer, which in the end was what the press did anyway and in the absence of firm information we get those 1960s psychological biases like he was a homosexual scared of women etc etc

This reminds me of the Belli letter when Zodiac says there is this thing in me. both authors maybe alluding to a mental illness of some sort and more importantly that they are fully conginscant of said illness. I never really understood what the confession letter author meant by saying he was not sick, that he was insane. What is insanity if not the ultimate mentall illness? Unless he was using it in some bizarre way of pride, being insane trumping all other lesser forms of psychological illness? If the confession letter and Zodiac both felt the need to write about possible mental illness, and if we assume for a second they were being truthful, would be interested to know if they ever had a formal medical diagnosis or were just self diagnosing.

this reminds me of every Zodiac communication in which he put a score of kills against the SFPD score of 0 to represent he had not been caught by the police. scores of the game?

reminds me of July 31st 1969 letter, the bus bomb letters , 2 cops pulled a goof etc where Zodiac wants parts of his communication to be published in the press and initially coming with a threat if the cipher was not published then it could result in more victims. Same kind of twisted logic turning it around so that the responsibility of anything that follows from not publishing the letter rests with those that made that decision rather than the killer himself.

Good observations Damien. I suppose the big question is can we eventually prove that the Zodiac Killer was responsible for this communication even if he wasn't involved in the murder. If we could somehow discover beyond any reasonable doubt that the Confession letter was typed by the killer of Cheri, then this should elevate the likelihood of Zodiac involvement. How much though is difficult to quantify.

Richard, this is the kind of analysis that I think is very important to this case. I am an American lawyer and a historian. Yet, I never even thought of this coincidence. I wonder what it says about the letter-writer. At the bare minimum, the writer followed national news. This is simply awesome information.

Thanks a lot for the compliment. I have previously looked at the religious angle for this letter, but bearing in mind it was a long confessional addressed to the chief of police, I searched the newspapers for the term "conression" and "police", which hit on the Miranda rule. Whether or not this was the intention of the author isn't certain but it's a reasonable shout. Mocking the police isn't exclusive to Zodiac, but we have to consider the rarity of killers contacting the police (with a fairly long correspondence), somebody who claimed to have rang police, plus the Riverside Desktop Poem and Bates' letters which I believe were also written by the Confession letter typist. With the last trinity of letters in 1967 mirroring the trinity of letters in 1969 from a quantity perspective (which is even rarer) it does make you wonder. Not saying I'm convinced of a Zodiac connection to Riverside, but we have to at least consider the possibility.
